Florida Foreclosure Law

Foreclosure in Florida occurs when you fall behind in your mortgage payments and the lender decides to seize the loan’s collateral: your home. In most cases, the lender will wait up to 120 days after your first missed payment to begin the foreclosure process. At this time, the lender will send you a letter informing you of its intent to foreclose. After you have received this letter, you have 30 days to pay the deficiency. If you are not able to bring the loan current, the lender will begin formal foreclosure proceedings.

Florida law requires lenders to engage in judicial foreclosure, which means that a lender must file a lawsuit in order to foreclose on your home. You will receive a Notice of Foreclosure when the process begins, and you will have 20 days to take action. If you don’t respond by the deadline, the lender will most likely be granted a default judgment and your home will be sold. If you do respond within 20 days, a hearing will be scheduled to determine whether the lender has the right to sell the home.
